COURT TO PASS FINAL JUDGMENT ON ASAMOAH GYAN’S RAPE, SODOMY, & EXTORTION CASE TOMORROW

Accra Circuit Court 9 judge, Ms. Afia Agbanu Kumador, has set Wednesday, 20th March, 2019, to pass judgement on Ghana’s national team (Black star) captain, Asamoah Gyan’s rape, sodomy, and extortion case involving the state and 4 accused persons, namely; Osarfo Anthony (Arts/Entertainment Writer), Chris Handler (Blogger), Sarah Kwablah (Law Student), and Ekow Micah (Musician).

Background Of Case

Daily Guide newspaper, published a story in June, 2015, which alleged that Sarah Kwablah, a 21-year-old student, wants to blackmail Asamoah Gyan with a sex video involving the two parties. The story caught national attention and was met with mixed beliefs and fraught with several conspiracy theories.

Sarah Kwablah’s side of the story, was however not captured in the publication. According to the paper, though they reached out to her via SMS, she failed to respond at the time of going to press.

Just after the publication, Sarah Kwablah approached Osarfo Anthony – then a writer for online media GHbase.com and gave her side of the story, which had it that, Asamoah Gyan raped and sodomized her which was caught on a CCTV in her house, but Daily Guide twisted the narrative of the story as “consensual sex” (video) to favour Gyan.

Sarah furnished Osarfo with all WhatsApp chats between Gyan and her, still pictures of her bloody naked body after the rape and sodomy she sent to Gyan – which alarmed Gyan, making him apologize for what he did, and Gyan’s WhatsApp voice notes in which he can be heard loud and clear, pleading with the girl not to let anyone see or know about what happened between them.

The site (GHbase.com) investigated and published more revelations on the alleged rape and sodomy story.

Asamoah Gyan’s team contacted the site’s Editor, Chris Handler and Osarfo, and pleaded with them to stop the publication.

The same Gyans, later, turned around to accuse Osarfo and 3 others, of conspiring to extort money from Gyan with their publications. Osarfo Anthony, Chris Handler, Sarah Kwablah, and Ekow Micah, were arrested, charged with conspiracy to extort money and arraigned before court.

Court Facts On Trial After 3 Years

The trial, which promised to be over within some few months due to eagerness, assurance, and readiness from Asamoah Gyan’s lawyer and manager to the press – to substantiate their allegation and have the accused ones convicted, has been characterized with shocking and farcical drama in court over the past 3 years.

The first State Prosecutor, ACP Moses Atibilla, relieved himself from the case in strange circumstances; ushering in a Police Prosecutor who also appeared in court for a little over 3 months and handed the case to another State Prosecutor after change of government in 2017.
The current State Prosecutor, Mr. Richard Gyambibi, appeared a few times in court and vanished into thin air without any formal reason to the court. Some police prosecutors in court always held his brief.

The court has thrown out all evidences: chats, SMS, pictures, audio voices, and video, the prosecution tendered against the 4 accused. The evidences were described by defence counsels as fictitious, doctored, and maliciously ‘piece-meal’ to implicate the accused ones. The court, convinced after examining the evidences, struck them all out.

Mr. Mathew Banahene, the landlord whose house Gyan allegedly raped and sodomized Sarah Kwabla (then a tenant), testified just once and stopped going to the court. Mr. Banahene had told the media Sarah Kwablah had pleaded with him to lie to the public he heard her “screaming” when Gyan was raping her, to make her story believable so she extorts money from Gyan and reward him with $ 20,000.

Mr. Banahene fumbled ingloriously in court, conduct, that made the defence counsels respectfully prompt the judge:

“My Lord, humbly take note of his conduct. This is how false witnesses behave in the box.”

Defence counsels, Maurice Ampaw and Apanga Lamtiig, punched holes into Mr. Banahene’s wild testimony during cross-examination, describing it as “concocted.” His mouth was not sealed by the court but he stopped going to court to testify. He discharged himself.

The Police Investigator in the case, Richmond Ayayi, was interdicted from the police service for his involvement in an alleged 60 billion cedis gold theft. Though he claimed in his testimony that he’s still a police officer, he could not provide any evidence of reinstatement under cross-examination – till his mouth was sealed and discharged.

Asamoah Gyan’s manager, Samuel Annim Addo, who is the complainant in the trial, stopped going to the court over a year now. In his testimony to the court, Samuel Annim shockingly confessed that its Gyan’s lawyer, who advised him to implicate Osarfo Anthony.

Asamoah Gyan’s lawyer, Kissi Agyebeng, who was the believed last witness for the prosecution, after telling the judge in open court a year ago that he will be the next witness, has failed to appear in court to testify. He’s currently no more the lawyer for Asamoah Gyan.

Judge Closes Prosecution’s Case

The trial judge, Ms. Afia Agbanu Kumador, having patiently allowed the prosecution to drag the trial unduly for over 3 years, closed the case of the prosecution “suo motu” (on the court’s own authority):

“The Attorney General Officer, Richard Gyambibi, who is in charge of this case is absent; though the court has adjourned several times to enable him come to court to continue prosecuting this matter.

“The PW3 (Landlord) who is in the box, failed to avail himself in court for further cross examination. His evidence is hereby expunged from the records. The court ‘suo motu’ closes the case of the prosecution because despite the substantive prosecutor and the witness having been given several opportunities to come to court to prosecute this matter, they have failed to do so. The case of the prosecution is hereby closed.”

Defence Counsels’ Remarks

All 4 accused, instructed their lawyers to file a submission of no case – which was done, presented, and accepted by the trial judge. According to defence lawyer, Maurice Ampaw;

“All the accused ones did not commit any crime and so this whole trial is a waste of the court’s time, my time, my client’s time, and all who followed this case’s time! Prosecution has not been able to establish any case against any of the accused because the accused ones did not commit the alleged crime in the first place! They are all innocent from day one!

“Prosecutor, complainant, and witnesses have all ran away (laughed)! We were always present in court – daring them to face us! We were fully prepared for this trial but they ran away. I knew they will run away because they have no case.”

He added that, “There’s no need to open any defence. It will be a waste of time for the court and my clients. We want the court to pass judgement based on the submission of no case we submitted. The court accepted it and the judge has written her verdict. The press and all those who want the truth, should be in court to listen to the ruling. Thank you.”

Judge Sets Date For Passing Judgement

Come Wednesday, 20th March, 2019, Accra Circuit Court 9 will see the trial judge, pass verdict for all and sundry to know whether the suspects are guilty or innocent.

ASAMOAH GYAN’S RAPE AND SODOMY CASE GOES BACK TO ATTORNEY GENERAL

asamoah-gyan-1The Prosecutor in the ongoing trial of four suspects, Osarfo Anthony, Ekow Micah, Sarah Kwablah, and Chris Handler, accused of extorting money from Asamoah Gyan, has disclosed to court that the docket of the case has been referred to the office of the Attorney General.

This news came as a big shock to the trial judge and all in court on Thursday, 3rd November, 2016, as the case which is over a year and gradually reaching a closure, has to be referred to the Attorney General’s office.

On the day, Asamoah Gyan’s lawyer, Kissi Agyabeng, was the next witness to testify but was nowhere to be found when the case was called. When the trial judge asked where he was, the Prosecutor said, “My Lord, the docket of this case has been referred to the Attorney General’s office.”

Asked why the referral to the AG’s office without a copy of such a letter to the court, the Prosecutor could not give any answer. The judge therefore asked the Prosecutor to furnish the court with the letter come 24th November, 2016.

Lawyer Kissi’s Scheme

First witness in the case, in the person of Asamoah Gyan’s manger, Samuel Annim Addo, told the court that Osarfo Anthony was doing publications on the Gyan and Sarah Kwablah rape and sodomy allegations last year on a blog, GHBase.com, Osarfo writes for.

A witness in the case, Nii Amarh Armateifio, a worker at 3 FM at TV3, approached Osarfo and asked him to stop the publication and that whatever money the latter’s media house, will lose, they are prepared to negotiate for Asamoah Gyan to pay the publishing cost to kill the story.

Osarfo, insisted the whole proposal be put on paper and signed; something both parties agreed and did. On the day Asamoah Gyan’s manager met Osarfo and gave part of the agreed sum, the police arrested Osarfo and later charged him for extorting money from Gyan.

According to Asamoah Gyan’s manager, Sammy Annim, it is Gyan’s lawyer, Kissi Agyabeng, who directed him on the whole scheme to get Osarfo arrested. To achieve what? Lawyer Kissi could not be in court to explain himself – yet, the case has been referred to the AG.

Possible Reasons For Referring Case To AG

A number of lawyers, who were in court and have been following the case, were equally appalled at the sudden u-turn by the Prosecutor in taking the docket back to the AG. They gave reasons and possible outcomes on this latest development of the case.

“Probably, the Prosecutor is detecting that they can’t win the case or their evidences are not strong enough so they want to withdraw the case” one lawyer explained. Another lawyer also said, “It’s obvious the Prosecutor has no case. I have been following this case since last year. They have just wasted the time of the court and that of the accused.”

They further explained that if the AG does not want to continue the case, it will issue what is called Nolle Prosequi – a term in law which means “will no longer prosecute”. It amounts to a dismissal of charges by the prosecution.

 What Will Be The Fate of The Accused Persons?

The lawyers explained that once the Prosecution discontinues the case, the accused shall be discharged but that does not mean they are free in the true sense of the word- because the case was not determined or judgment was not passed. The AG can reopen the case anytime it so deem fit– because the accused have not been acquitted and discharged.

The legal battle between Asamaoh Gyan- captain of Ghana’s senior National soccer team and four defendants is still going on and Nkonkonsa.com brings exclusive updates.

Exclusive Nkonkonsa.com update on the ongoing trial of four suspects, Osarfo Anthony, Ekow Micah, Sarah Kwablah, and Chris Handler, accused of allegedly conspiring to extort money from Asamoah Gyan, is that, Gyan’s lawyer, Kissi Agyabeng, is the next witness to testify in court.

On Thursday, 20th October, 2016, when the case was called, lawyer Kissi Agyabeng was in court. When the trial judge asked the prosecutor if he has any other witness to testify in the case, lawyer Kissi raised his hand and said he is the next witness. He however could not testify because he had to go to another court for a case.

Lawyer Kissi’s Scheme

Lawyer-To-Lawyer Cross-Examination

The next hearing is expected to be an interesting one; as lawyer Ampaw and lawyer Lampting Apanga, shall be drilling lawyer Kissi Agyabeng under cross-examination. A learned friend, cross-examining another learned friend will certainly be an interesting one; since they both understand each other’s language very well. Lawyer Ampaw promises to make more shocking revelations about Gyan during cross-examination of lawyer Kissi.

 Investigator Discharged

The Investigator for the case, Richmond Ayayi, who came to court to testify, has finally been discharged. The Investigator, who is no longer a worker in the Ghana Police Service due to interdiction – for allegedly stealing GHC 20 million and several bars of gold from an Indian company in Osu, told the court that he has been reinstated. Asked to bring his reinstatement letter to the court, he could not produce it till his discharge from the case.

Lawyer Ampaw Exposed Investigator

Lawyer Maurice Ampaw who is the defense counsel for the 3 accused:Osarfo Anthony, Ekow Micah, and Sarah Kwablah, exposed the Investigator by telling the court how the Investigator, doctored the voices of the four accused by stitching their voices together, so that when one listens to their conversations, it sounds or appear as though they planned evil against Gyan. He also told the court how the Investigator deleted some voice recordings which the latter knows can help Osarfo and the others prove their innocence in the trial.

Audios Thrown Out

The court has therefore thrown out the audios because they turn out to be mere pictures and a video in the court’s records, labelled as Exhibit C– which the prosecutor and the Investigator, could not identity.

ASAMOAH GYAN’S EVIDENCE IN RAPE & EXTORTION CASE THROWN OUT OF COURT

The four suspects – Osarfo Anthony, Ekow Micah, Sarah Kwablah, and Chris Handler, accused of allegedly conspiring to extort money from Asamoah Gyan, may have to heave a deep sigh of relief as the High Court, has thrown out their alleged phone conversations tendered in court by Asamoah Gyan, against them.

This revelation happened in court on Tuesday, 20th September, 2016 when the Investigator in the case, told the court that he extracted voices of the four accused from a CD– and in that voice recordings, the four can be heard loud and clear, planning on how to extort money from Gyan for allegedly raping and sodomizing Sarah Kwablah.

The Investigator told the court that he gave the said voices to the complaint in the case – in the person of Samuel Anim Addo, who is the manager of Asamoah Gyan to tender in court. Sammy, on 10th February, 2016, Samuel Anim Addo tendered the audios and was duly played in open court for all to listen.

LAWYER AMPAW EXPOSES INVESTIGATOR
Lawyer Maurice Ampaw who is the defense counsel for the 4 accused, exposed the Investigator in wrapping up his cross-examination by telling the court how the Investigator, doctored the voices of the four accused by stitching their voices together, so that when one listens to their conversations, it sounds or appear as though they planned evil against Gyan.

He also told the court how the Investigator deleted some voice recordings which the latter knows can help Osarfo and the others prove their innocence in the trial. “When you were extracted those audios, was any of the accused present or witnessed it?” Lawyer Ampaw asked the Investigator – who responded, “No my lord.” Asked to explain why, he said “nothing my lord.”

SIX MONTHS LATER
Six (6) months after the tendering of those extortion tapes which were labeled exhibit C in the court’s records, the audios turn out to be mere pictures and a video – which the prosecutor and the Investigator, could not identity what they are about.

PROSECUTION’S PLEA OVER-RULED

The prosecutor therefore argued that the court should allow them play the same audios from a laptop or upload the audios from the laptop unto a pen drive – but the trial judge ruled, “That is now possible because these new audios you claim and the laptop are not exhibits in the court’s records. They have not been tendered and cannot be tendered at this time.” The trial judge however, admitted that she recall the alleged extortion taps was played in court.

BENCH WARRANT ISSUED AGAINST EKOW MICAH
Sarah Kwablah and Ekow Micah were absent in court. Lawyer Lampting Apanga, told the court that Sarah’s absence is due to severe abdominal pains she is suffering as a result of her menses but Ekow was on his way to the court – an excuse the judge refused to accept and for that matter issued a bench warrant for his arrest.
Next Adjournment

The case continues on 4th October, 2016. The Investigator is expected to present to the court, Osarfo’s laptop, desk top computer, modem, phone, bag and others which they went to his house at 10: 30 pm to take to assist investigations– after which he will be discharged.

“ASAMOAH GYAN MUST BE IN COURT” – MAURICE AMPAW INSISTS

The ongoing trial of 4 persons, Sarah Kwablah, Osarfo Anthony, Ekow Micah, and Chris Handler for allegedly extorting money from Asamoah Gyan was heard in court on Thursday 28th January, 2015.

The hearing continued with further cross-examination of his manager, Samuel Anim Addo, who is the main complainant for the soccer star in the case.

Dr. Maurice Ampaw, who is the defense counsel for the 4 accused continued his cross-examination which he had started about a month ago.

Since the extortion case came about as a result of an alleged rape/sodomy case, lawyer Ampaw continued his cross-examination from the alleged rape/sodomy against Asamoah Gyan as a build-up to the substantive charge – extortion against his clients.

In an earlier ever-dramatic cross-examination, lawyer Ampaw asked the below:

Maurice Ampaw: Explain your managerial role to Asamoah Gyan to this court.

Samuel Anim: I manage his businesses, PR, Family and social life.

Maurice Ampaw: Do you mange Asamoah Gyan’s love, sex, and women affairs?

Samuel Anim: I don’t understand the question my lord.

Maurice Ampaw: I mean if Asamoah Gyan is going in for a woman or have sex with her, do you manage that too?

Samuel Anim: My lord I have my limit.

Maurice Ampaw: Tell this court the extent of your limit?

Samuel Anim fumbled for seconds until the judge objected that question.

Maurice Ampaw: What is Sarah Kwabla to Asamoah Gyan?

Samuel Anim: A friend.

Trial judge warned Samuel Anim not to answer questions as though he is contesting the lawyer. “Address me” said the judge.

Maurice Ampaw: What kind of friend – girlfriend? Concubine?

Samuel Anim looked dazed and tired of answering. He heaved a deep sigh of relief.

Maurice Ampaw: What did Asamoah Gyan go to do in Sarah’s house?

Samuel Anim: My lord I don’t know.

Maurice Ampaw: Did you enter Sarah’s apartment?

Samuel Anim: No my lord. Only Asamoah did.

Maurice Ampaw: So you don’t know what Asamoah did with Sarah inside right?

Samuel Anim: Yes my lord.

Maurice Ampaw then put it to Samuel that, “Asamoah Gyan followed Sarah upstairs, pounced on her, raped her and after, forcibly had sex with her in her anus! He raped and sodomized her! After, Sarah bled profusely! Asamoah Gyan then pulled a knife at her….He warned her not to let the public or anyone know this.

Samuel Anim: I was not there my lord.

Maurice Ampaw: He also told Sarah that if she keeps shut on it, he will give her any amount of money she asks for.

Samuel Anim: I was not there my lord.

Maurice Ampaw: I put it to you that Asamoah had confrontation with Sarah and picked a knife to stab her.

Samuel Anim: I was not there my lord.

Maurice Ampaw: Later Sarah got pregnant and Asamoah Gyan asked you to manage it – true or false?

Samuel Anim: My lord it’s not true.

Maurice Ampaw: Samuel Anim, I suggest to you that you are not being truthful to this honourable court! You convinced Sarah to abort the pregnancy. You took her to a quack doctor to have the pregnancy aborted! I suggest to you you are not being truthful to this court!

Samuel Anim: My lord I’m being truthful.

When all the answers coming from Samuel Annim were all in the no-affirmative, the trial judge asked Lawyer Ampaw to drift from that angle a plea that charged Lawyer Ampaw to retort, “They are not prepared to produce Asamoah Gyan to court. If they are, they should bring him as witness.” (Laughed teasingly).

The Prosecution got up and reacted, “You don’t tell the prosecutor who he brings to court as witness. We will determine that. We can choose to bring him or not.”

Lawyer Ampaw made more disclosure in his cross-examination by asking Samuel Anim more questions bothering on rape/sodomy. He told the court that Samuel Annim once sent him a Whatsapp message in which Sammy Annim, stated that if Asamoah Gyan fucked Sarah Kwablah and so…..

“My lord, Sammy Anim sent me lawyer Maurice Ampaw a Whatsapp message and in the message he said…my lord sorry the word he used is a bit unpleasant for me to say… he said and I’m quoting him, “If Asamoah Gyan fucked her and so…?” lawyer Ampaw told the court.

Sammy Anim, in his response, told the court that he never sent any such message to the celebrated lawyer. Sammy Annim had told the court earlier in cross-examination that Asamoah Gyan never told him anything about his affair with Sarah Kwablah – so lawyer Ampaw put it to Sammy Annim that he is not being truthful to the court, because, he Sammy Annim sent a Whatsapp message to Sarah in which he indicated, he quoted, “I am aware of everything from day one.”

Again, Samuel Anim denied having sent any such message to Sarah. “Asamoah Gyan directed you Sammy to confirm A1’s (Sarah) pregnancy at the hospital” lawyer Ampaw put it to Samuel Anim — which the latter admitted is true.

Lawyer Ampaw asked Sammy Anim, “You have already told this court that you have no knowledge of the affair between Asamoah Gyan and A1 (Sarah) because Asamoah Gyan never told you anything about their affair – – so how did you get to know that Sarah got pregnant?

Samuel Annim then told the court Asamoah Gyan told him about the pregnancy after 3 months when Sarah claimed she is pregnant. Lawyer Maurice Ampaw ended his cross-examination but will continue so in the next hearing come 8th Feb, 2016.

If the prosecution does not bring Asamoah to court to either confine or deny the allegations lawyer Ampaw has put and suggested to Samuel Anim, they become facts in the eyes of the law in the trial – hence the need for him to appear before court to testify.
